ELIGIBILITY: The “A Charlottesville Wedding Gift” contest (the “wedding”) is open and offered only to legal residents of the Charlottesville area (within a 25 mile radius of Charlottesville) who are 21 years of age or older at the time of entry. One member of each “participating couple” must reside within this designated area. Vow Renewals will be considered.
AGREEMENT TO OFFICIAL RULES: By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsors (participating vendors) and the venue (Early Mountain Vineyards), which are final and binding in all matters relating to “A Charlottesville Wedding Gift.” Winning any part of the contest is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: The “A Charlottesville Wedding Gift” contest entry period begins at 12:00 am Eastern Daylight Time (“EST”) on March 14th, 2014 and ends at 11:59pm EST on April 30th, 2014. Participants are invited to the webpage page located at http://www.acharlottesvilleweddinggift.com to enter the contest. To enter, participants are asked to enter their name, address, and email address (and phone number), and then will submit their Essay (along with a current photograph of themselves together as a couple) described on that website. Small video submissions are encouraged too. “A Charlottesville Wedding Gift” is not responsible for late, incomplete, misdirected or delayed entries. Incomplete or false information will result in disqualification of entry. All entries become the exclusive property of “A Charlottesville Wedding Gift” and will not be returned.
ESSAY REQUIREMENTS: Current names, ages and contact information, along with an attached photograph are required. Refer to Enter Now for current requirements.
DRAWING AND NOTIFICATION: The Winner will be selected from among all eligible entries received during the Contest Submission/Entry Period by the Judging Panel, whose decisions are final and binding. The announcement of winners (or semi-finalists) will be on June 1, 2014, or updates will be posted on the website. The winner will be notified by electronic mail (and/or phone) directed to the email address (and/or phone number) provided with the essay. There may be a required in-person interview (by one or more judges from our panel) of semi-finalists before winners are chosen. One member of the chosen couple(s) will be required to meet with the Judge(s) if in-person interviews are required.
GIFT: The “A Charlottesville Wedding Gift” winners will receive a wedding on Saturday, March 14, 2015, which includes the prizes/sponsors (subject to change until March 14th, 2015) updated on the website. The date is non-negotiable.
GIFT CONDITIONS: By entering (and accepting any prize), the winner agrees to release and forever discharge the sponsors (participating vendors), their officers , employees, agents and volunteers from and against any and all claims, actions, causes of action, judgments, liabilities whatsoever for any injuries, losses, or damages of any kind or nature caused by, arising out of or resulting from entering the promotion or for injuries or damages of any kind or nature caused by, arising out of or resulting from any prize or service, or resulting from acceptance, possession, or use/misuse of any prize/service awarded. All local, state and federal taxes are the sole and exclusive responsibility of the winners and/or any other fees/costs associated with the receipt of any prize. No substitution or transfer of prize or election of cash in lieu of prize will be permitted.
“A Charlottesville Wedding Gift” reserves the right at its sole discretion to substitute any prize/service package with another prize/service provider as needed. If a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue. All taxes, if applicable, are the sole and exclusive responsibility of the winner. The winner’s entry, and acceptance of the prizes offered constitutes permission (except where prohibited) for the Sponsors to use said winner’s name, photograph, video, likeness, statements, biographical information, voice and in all forms of media, in perpetuity, without notice or further compensation.
VENUE REQUIREMENTS: Early Mountain Vineyards (and its representatives and partners) requires an event contract (standard procedure for weddings), and a damage deposit or credit card number from the couple.
CEREMONY: The couple may (depending on religious or ceremonial requirements on their part) be responsible for securing their officiant for the ceremony.
GENERAL: By accepting the offer as Winner, where permitted by law, the Winner grants to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the Prize Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL “A Charlottesville Wedding Gift’s” sponsors BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. By participating, entrants release and agree to indemnify and harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON INTELLECTUAL PROPERTY OR PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Contest or its related activities or the acceptance, possession, use or misuse of or any harm resulting from the acceptance, possession, use or misuse of the Prize. Prize Winner acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize. The winner will be required to agree to these rules by signing a contractual agreement (with the “A Charlottesville Wedding Gift” group) once chosen.
USE OF IMAGERY: All imagery (photography and video) of the wedding and winners is shared property of the contest winners and “A Charlottesville Wedding Gift” and it’s sponsors/vendors. Media use for promotion/marketing/editorial exposure is to be expected.
DISPUTES: Except where prohibited by law, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Wedding or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Virginia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with “A Charlottesville Wedding Gift,” shall be governed by, and construed in accordance with, the laws of Virginia, without giving effect to any choice of law or conflict of law rules (regardless of the jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
MISCELLANEOUS: This is the complete agreement between the parties concerning the subject matter hereof and all prior agreements are merged herein. This Agreement is to be construed according to Virginia Law. Time is of the essence with respect to Clients’ obligations assumed in this Agreement. If any dispute arises in connection with or relating to this Agreement or relating to a claim which arises under this Agreement, (1) the parties agree that the dispute shall be heard in the Courts of Charlottesville, VA; and (2) the parties consent to the personal jurisdiction of said courts and waive the right to transfer venue.
Rules and sponsors are subject to change depending on scheduling/family conflicts among sponsors. The A Charlottesville Wedding Gift and its sponsors reserve the right to alter the rules/specifications/requirements as needed. Harvest Moon Catering will attempt to work with the couple on creating a personalized menu, but ultimately holds rights to select the final food and beverage options.
The number of wedding guests will be determined according to the location of the ceremony and reception at Early Mountain Vineyards, which has several location options. Harvest Moon Catering, Early Mountain and/or Dickie Morris will make the final decision on number of guests allowed. IN NO EVENT WILL “A Charlottesville Wedding Gift’s” SPONSORS OR VENDORS BE RESPONSIBLE OR LIABLE IN ANY MANNER FOR THE FAILURE OF ANY SPONSOR OR VENDOR’S FAILURE TO PERFORM OR FOR ANY ACT OR OMISSION.
